Wyatt Earp Case Upholds Right to Dispose of your Property After Death
In a recent case, the California Appellate Court upheld the right to dispose of your property however you wish upon your death. Hugh O'Brian, best known for playing Wyatt Earp in the hit '50s television show, died in 2016. He left a trust where he stated his intention to disinherit his children, whether known or unknown. After his death, four individuals claiming to be his long-lost children claimed a share of his estate under the omitted children rule, resulting in a four-year court battle. The court ultimately upheld O'Brian's right to dispose of his property how he wished.
This case highlights the importance of having your wishes clearly stated in your estate-planning documents. Your right to dispose of your property according to your wishes can only be carried out if they are clearly stated. A generic fill-in-the-blank trust might not be sufficient if someone decides to challenge your estate plan after your death. When creating an estate plan, ask yourself: "Are my intentions clearly stated in my estate plan?"
