New Tech can Help Parents who Struggle with Alcohol
A parent who struggles with an addiction to alcohol or who has a history of drinking can face difficulty getting child custody or parenting time. Despite their desire to get help and get sober, that previous history will hurt them in court. However, new technology has been developed that allows for remote alcohol monitoring, which can keep parents 100% accountable and enhance a child's safety. SoberLink created a remote alcohol testing mechanism to help individuals who wish to end their struggle with alcoholism. The technology enables the court to make sure parents are not impaired while parenting. It detects blood-alcohol content (BAC) at any given time and documents their BAC for accountability. Because of this, a parent who struggles with alcohol abuse may face reduced parenting time or be required to be under supervision. Death of Anne Heche Creates Public Drama
Last August, actress Anne Heche died at 53 years old following a tragic car accident. She was survived by two young sons.
Heche's eldest son filed a petition for probate alleging that she had died intestate. However, James Tupper, Heche's ex-boyfriend and father of her youngest son, filed an objection, claiming Heche left a will naming him as her executor.
When someone dies leaving a will, it needs to be lodged with the court. The court then determines the authenticity of the document. If the original will is not available, then the court presumes the will was destroyed with an intent to revoke it. This means that Tupper will need to find the original will and lodge it with the court. Failing that, he will need to provide evidence that the will was still in existence when she died. At time of print, Tupper has done neither.
It is too early to know where this case will go and for how long. What we know is that this drama will be carried out in public court. Anne Heche could have avoided this mess by using a trust and keeping it updated. Then Heche could have made it clear who she wanted in charge of her affairs and how her estate should be settled.
