Gene Hackman's Estate Planning Nightmare
Actor Gene Hackman and his wife, Betsy Arakawa, passed away last February. The horrible circumstances surrounding their deaths are compounded by their estate plan.
Hackman's will, created in 2005, provided that his entire $80 million estate would go to Arakawa - and no alternate was named. Hackman apparently presumed that his wife would outlive him. However, Arakawa died seven days before Hackman. Hackman, stricken with Alzheimer's, was unable to update his will before dying. Since Hackman's will did not provide an alternate beneficiary, his estate will likely go to his intestate heirs, his three estranged children from a previous marriage.
Moreover, the successor executor of Hackman's will is the drafting attorney who died in 2024.
Even worse: A will, even when properly functioning, provides no protection against estate taxes, creditors, probate or a nosy public. In short, Hackman's will is useless and ineffective to deal with his estate's particular issues.
There are several lessons to take from Hackman's death. First is the importance of naming alternate beneficiaries and executors, even if the likelihood they would inherit is low. Second is the use of trusts to protect against estate taxes, creditors, probate and to provide privacy for the family. Third is the need to keep that plan up-to-date to reflect your current situation. Finally, the big lesson is to not wait to fix errors and fill in gaps - because there may not be enough time or mental capacity to make corrections in the future.
