Recently, England played Italy in the UEFA soccer cup final. The game was tied 1:1 on goals and went into extra time. Neither team scored during the extended 30 minutes, and so the game was decided on penalty shoot-outs. England lost by missing three of their five penalties.
I see so many correlations between sports and the world of commerce - people working together towards a common goal. Sadly, on this occasion it was the missing of goals that caused one team to lose and another to win.
Blockbuster missed the goal of what customers wanted, and so Netflix won. Taxi drivers missed the goal of providing quality service and transparent pricing, and so Uber and Lyft won. The hotel industry missed the goal of flexible pricing and local availability, and so Airbnb won some of their business.
Sports teams lose games because of their own errors, capitalized upon by their opponent. In the world of commerce, an organization can become a distant memory if they lose sight of their primary goals.

Britney Spears' Nightmare Conservatorship Shows the Importance of Incapacity Planning
After some erratic behavior in 2008, Britney's father was awarded a conservatorship over Britney and her entire life. Conservatorships are important tools where someone is unable to manage their affairs or resist undue influence. In a conservatorship, the court awards someone else the right to manage some or all aspects of another adult's life. Ending a conservatorship can require permission from the court, psychological examinations and is often resisted by the conservator. The burden is on Britney to prove she can manage her own affairs, which is nearly impossible when you can't even hire your own attorney.
Britney's situation could have been better managed with incapacity planning. With a Power of Attorney and Advanced Healthcare Directive, Britney could have gotten the help and support she needed from those she chose. As soon as she felt her father was not acting in her interests, she could replace him or revoke the documents. She could have gotten legal advice and support without permission from her father or the court. The burden would be entirely on him to prove she lacked mental capacity to remove or replace him as her agent.
The lesson here is if you want to remain in control as long as possible, do incapacity planning when completing your Will or Trust. Otherwise, you could be left to the mercy of the courts or others.
