Transferring your Home? Avoid These Common Dangers
Many people believe that simply transferring their home to their loved ones is an easy way to avoid estate planning. However, there are several hidden dangers that you need to consider before making the transfer.
When you transfer your home to a family member, they take on the taxes from any gained equity since you purchased the home.
If you transfer your home within five years of starting Medi-Cal, the value of the home could be counted toward your eligibility requirement, resulting in months or years of ineligibility.
If the family member who receives the home enters divorce proceedings, the home could be split between each spouse and/or affect child support awards.
In the event of bankruptcy, bankruptcy creditors could demand some or all of the home and/or any rents from the home.
If your loved one becomes incapacitated or predeceases you, the property will be distributed according to their estate plan or probate.
By transferring even a portion of the home, you lose control - allowing the loved one to sell the home right out from under you.
